Section 01

1 Acceptance of Terms

Welcome to Prowiser ("Platform", "we", "us", or "our"), an academic management platform developed and operated for use by educational institutions, faculty members, and students in India. The Platform is accessible at prowiser.in and its associated subdomains.

By accessing or using any part of the Prowiser Platform — whether as an Administrator, Faculty member, or Student — you ("User") agree to be legally bound by these Terms of Use ("Terms"), our Privacy Policy, and any additional guidelines or policies that may be published on the Platform from time to time.

📋 If you do not agree to these Terms, you must immediately cease using the Platform. Continued use of the Platform following any update to these Terms constitutes your acceptance of the revised Terms.

These Terms form a binding legal agreement between you and Prowiser. If you are accessing the Platform on behalf of an educational institution, you represent that you have the authority to bind that institution to these Terms.

Section 02

For the purposes of these Terms, the following definitions apply:

The Prowiser web application, including all modules, APIs, databases, and associated software hosted at prowiser.in.
Institution
An educational organization (college, university, or school) that has subscribed to or been granted access to the Platform.
Administrator (Admin)
A user with elevated privileges responsible for managing faculty accounts, configuring the Platform for an institution, and overseeing access control.
Master Administrator
The highest-privilege system-level account responsible for managing institutions and platform-wide configuration. Operated solely by Prowiser.

Services
All features offered by the Platform, including the Question Bank, Randomized Quiz, Online Quiz Taking, Attendance Management, Semester Grading, and Faculty Feedback modules.
Section 03

3 Eligibility & Account Registration

Eligibility. The Platform is intended solely for use in an authorized academic context. You must be:

  • An Administrator or Faculty member with valid credentials issued by your Institution; or
  • A Student accessing the Platform through a quiz or feedback link officially shared by your Faculty, using your Institution-registered email address for verification.

Account Security. Administrators and Faculty are responsible for maintaining the confidentiality of their login credentials. You must not share your password with any third party. You agree to notify us immediately at admin@prowiser.in if you suspect any unauthorized use of your account.

Accuracy of Information. You agree to provide accurate, current, and complete information during account registration and to keep such information updated. Providing false or misleading information may result in immediate account suspension.

⚠️ You are solely responsible for all activities that occur under your account. Prowiser is not liable for any loss or damage arising from unauthorized access resulting from your failure to safeguard your credentials.

No Student Account Creation. Students access the Platform exclusively via time-limited links provided by Faculty. Students are not required to register a separate account and are authenticated solely for the purpose of the specific quiz or feedback session.

Section 04

4 Permitted Use

Subject to your compliance with these Terms, Prowiser grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for the following academic purposes:

  • Administrators: Managing faculty accounts, configuring institution-level settings, overseeing module access, and viewing institution-wide academic reports.
  • Faculty: Building and managing question banks; creating, scheduling, and monitoring quizzes; recording and exporting attendance; computing semester grades and generating result sheets; and initiating anonymous faculty feedback campaigns.
  • Students: Taking assigned quizzes within the scheduled window; viewing personal scores and attendance records (where enabled); and submitting anonymous feedback through official feedback links.

All use of the Platform must be in accordance with applicable Indian law and the internal academic policies of your Institution.

Section 05

5 Prohibited Conduct

You agree not to engage in any of the following activities while using the Platform:

  • Attempting to access accounts, data, or systems you are not authorized to access, including but not limited to other users' quiz answers, grade records, or attendance data.
  • Sharing quiz access codes, links, or your quiz session with any unauthorized person during a live assessment window.
  • Using automated tools, bots, scripts, or any form of AI assistance to answer quiz questions during a live assessment session.
  • Attempting to circumvent tab-switch detection, timing controls, or any other academic integrity mechanisms embedded in the Platform.
  • Submitting false, fabricated, or manipulated attendance data, marks, or feedback responses.
  • Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code of the Platform.
  • Uploading or transmitting malware, viruses, or any harmful code to the Platform.
  • Using the Platform to store or transmit content that is unlawful, defamatory, obscene, or in violation of any third party's rights.
  • Interfering with or disrupting the integrity, performance, or availability of the Platform or its underlying infrastructure.
  • Reselling, sublicensing, or otherwise commercially exploiting the Platform or any portion thereof without express written permission from Prowiser.
  • Impersonating any other User, Administrator, or Faculty member on the Platform.
🚫 Violations of this section may result in immediate account suspension, permanent ban, and — where applicable — referral to the concerned Institution's academic disciplinary committee or law enforcement authorities.
Section 06

6 Academic Integrity

Prowiser is designed to uphold the highest standards of academic fairness. The Platform incorporates a number of technical safeguards, and Users must understand and respect their purpose:

  • Randomized Question Sets: Each student receives a unique set of questions drawn from the Faculty's question bank. This is a deliberate integrity measure. Attempting to exchange or share specific questions during an active quiz session is a violation of these Terms.
  • Tab-Switch Detection: The Platform monitors and logs instances where a student navigates away from the quiz tab. These events are visible to Faculty in real time via the live monitoring dashboard. Repeated tab-switching may be flagged as a potential integrity violation at the Faculty's discretion.
  • Auto-Submission: Quiz sessions are automatically submitted when the allotted time expires, or upon browser close. No extensions will be granted through the Platform unless explicitly configured by the Faculty in advance.
  • Feedback Anonymity: Faculty feedback responses are anonymized by design. Any attempt to reverse-engineer the identity of a respondent from submission metadata is strictly prohibited.
  • Grade Integrity: Only authorized Faculty may enter, edit, or approve grade entries. Any unauthorized modification of marks or grade boundaries is a violation of these Terms and may constitute academic fraud.
🎓 Academic misconduct identified via Platform logs may be reported to the concerned Institution's administration. Prowiser cooperates fully with institutional disciplinary proceedings upon official request.
Section 07

7 Data & Privacy

Data Collection. Prowiser collects and processes personal and academic data — including but not limited to names, email addresses, quiz responses, attendance records, and grade data — to operate the Platform and deliver its Services. All data processing is conducted in accordance with our Privacy Policy.

Institution Data. Academic data entered by Users (questions, marks, attendance, feedback responses) remains the property of the respective Institution. Prowiser acts as a data processor on behalf of the Institution and will not use such data for any purpose beyond operating the Platform.

Student Data. Student-identifying information (name, email, enrollment number) is used exclusively to authenticate quiz or feedback access and to associate responses with the correct academic record. Prowiser does not sell, rent, or share student data with third parties.

Retention. Data is retained for as long as the Institution's subscription remains active. Upon termination of an Institution's account, data will be retained for a period of 30 days during which the Institution may request an export, after which it will be permanently deleted.

Security. Prowiser employs reasonable technical and organizational safeguards to protect data against unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet is entirely secure, and we cannot guarantee absolute security.

Section 08

8 Institution & Administrator Responsibilities

Institutions and their designated Administrators are responsible for the following:

  • Ensuring that all Faculty and Student users within the Institution are informed of and comply with these Terms of Use prior to accessing the Platform.
  • Maintaining accurate and up-to-date faculty account information, including prompt deactivation of accounts for faculty members who leave the Institution.
  • Configuring appropriate access controls for each Faculty member and ensuring module access aligns with institutional roles and responsibilities.
  • Ensuring that student roster data uploaded to the Platform (via CSV, Excel, or manual entry) is accurate and obtained with appropriate authorization under applicable data protection laws.
  • Communicating quiz schedules, access links, and instructions to students through official channels only.
  • Reporting any suspected security incidents, unauthorized access, or data breaches to Prowiser at admin@prowiser.in without undue delay.

Prowiser reserves the right to suspend or terminate an Institution's access to the Platform in the event of sustained or serious violations of these Terms by users under that Institution's administration.

Section 09

9 Intellectual Property

Prowiser IP. The Platform — including its software, source code, design, user interface, branding, logos, trademarks, and all proprietary algorithms (including the quiz randomization engine, attendance engine, and relative grading algorithm) — is and shall remain the exclusive intellectual property of Prowiser and its licensors, protected under applicable Indian and international intellectual property laws.

User Content. You retain ownership of all Content you create and upload to the Platform (e.g., question banks, course materials, grade schemes). By uploading Content, you grant Prowiser a limited, non-exclusive, royalty-free license to store, process, and display such Content solely for the purpose of operating the Platform on your behalf.

Restrictions. You may not copy, reproduce, modify, distribute, create derivative works of, or publicly display any part of the Platform's proprietary software or design elements without prior written consent from Prowiser.

Feedback. Any suggestions, ideas, or feedback you provide regarding the Platform may be used by Prowiser to improve the Services without any obligation or compensation to you.

Section 10

10 Platform Availability & Uptime

Prowiser strives to maintain high availability of the Platform. However, we do not guarantee uninterrupted or error-free operation. The Platform may be temporarily unavailable due to:

  • Scheduled maintenance windows (which will be communicated in advance where practicable);
  • Unplanned outages or technical failures affecting underlying infrastructure;
  • Events beyond our reasonable control, including force majeure events.

Faculty are advised not to schedule time-critical assessments without considering reasonable contingency plans. Prowiser shall not be liable for academic disruptions caused by Platform downtime.

Section 11

11 Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis, without any warranty of any kind, express or implied. To the fullest extent permitted by applicable law, Prowiser expressly disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
  • Any warranty that the Platform will be uninterrupted, timely, secure, or error-free;
  • Any warranty as to the accuracy, completeness, or reliability of any content or results obtained through the Platform.

Prowiser does not warrant that any defects or errors in the Platform will be corrected, or that the Platform is free of viruses or other harmful components. Users are responsible for maintaining adequate backups of their own data.

Section 12

12 Limitation of Liability

To the maximum extent permitted by applicable law, Prowiser and its officers, directors, employees, agents, and service providers shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages;
  • Loss of academic data, grades, or attendance records due to technical failure or user error;
  • Loss of revenue, reputation, or goodwill arising from use or inability to use the Platform;
  • Unauthorized access to or alteration of your transmissions or data by third parties.

In no event shall Prowiser's aggregate liability for any claim arising out of or relating to these Terms or the Platform exceed the total fees paid by the Institution to Prowiser in the three (3) months immediately preceding the event giving rise to the claim.

⚖️ Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, Prowiser's liability shall be limited to the maximum extent permitted by law.
Section 13

13 Termination

By Prowiser. We reserve the right to suspend or terminate your access to the Platform, with or without notice, if we reasonably believe that you have:

  • Violated any provision of these Terms;
  • Engaged in conduct harmful to other Users, the Platform, or Prowiser;
  • Provided false information during registration; or
  • Failed to pay applicable subscription fees (for Institutions).

By Institution/User. An Institution may request termination of its subscription by contacting admin@prowiser.in. Individual Faculty accounts may be deactivated by the Institution's Administrator at any time.

Effect of Termination. Upon termination, your right to access the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination — including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Governing Law — shall survive.

Section 14

14 Amendments to Terms

Prowiser reserves the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where reasonably practicable, notify active Administrators via the registered institutional email address.

Your continued use of the Platform after the effective date of any update constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Platform and contact us to terminate your account.

We encourage all Users to periodically review this page to stay informed of any changes.

Section 15

15 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. The provisions of the Information Technology Act, 2000 (as amended) and applicable rules thereunder shall apply to the extent relevant.

Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the courts of Lucknow, Uttar Pradesh, India.

Before initiating any formal legal proceedings, both parties agree to first attempt to resolve the dispute amicably through good-faith negotiation for a period of thirty (30) days from the date of written notice of the dispute.
